The Ultimate Complication: When the Lawyer Calls

Edward L. Raab, M.D., J.D.

Correspondence: Requests for reprints should be addressed to: Edward L. Raab, M.D., Department of Ophthalmology, Mount Sinai School of Medicine of New York University, One Gustave L. Levy Place, Box 1183, New York, NY 10029.

When contacted by the lawyer, accept service of the summons, notify your insurance carrier, and avoid discussions with other defendants or possible expert witnesses. Do not alter your records, which should have been made contemporaneously. Preventive measures include follow-up of patients under active treatment who miss appointments, and being sure that your informed consent procedures are carried out fully and documented.
